My Colorful World — Content, Intellectual Property & Takedown Policy

This Content, Intellectual Property & Takedown Policy (this "Policy") explains who owns the content on the My Colorful World service, the rights you grant and keep when you upload photos, and how to report content you believe infringes your rights. It supplements and is incorporated into our Terms of Service and should be read together with our Privacy Policy and Acceptable Use Policy. Capitalized terms not defined here have the meaning given in the Terms of Service.

In this Policy, "My Colorful World," "MCW," "we," "us," and "our" refer to My Colorful World LLC, 16200 NW 59th Ave, Suite 101, Miami Lakes, FL 33014, United States.

1. Ownership of MCW Content

All content we make available through the Service — including our website design, graphics, logos, software, sample artwork, coloring-page templates, and the line-art coloring pages and other outputs our technology and designers create from your photos ("MCW Content") — is owned by My Colorful World or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. Except as expressly permitted in Section 3 and in our Terms of Service, you may not copy, reproduce, modify, distribute, sell, publicly display, create derivative works from, or otherwise exploit any MCW Content without our prior written permission. All rights not expressly granted are reserved.

2. Your User Content and the Licenses You Grant

You retain the rights you hold in the photos and other materials you upload ("User Content"). You do not give up ownership of your family photos by using the Service. You grant us only the licenses needed to operate the Service, as set out in our Terms of Service and summarized here:

  • For photos submitted to create a product: a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, modify, and create derivative works from your photos (for example, converting them into coloring-page line art), together with the names and likenesses of the people and pets in them, solely to produce and deliver the product you order, to support reorders, and to meet our legal obligations. We will not use these personal photos for advertising or to train AI for unrelated purposes without your separate, explicit consent.
  • For reviews, testimonials, and other public submissions: a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that content to operate, promote, and improve the Service.

We may create and use de-identified or aggregated data derived from User Content for any lawful purpose.

3. Your Use of Finished Products and Downloads

When you purchase a personalized coloring book or other product, or download any complimentary printable or coloring page we offer, the following personal-use license applies unless we state otherwise in writing:

  • The finished product and any downloads are licensed to you for your own personal, non-commercial, and family or educational use.
  • You may print, color, and enjoy them within your household, and (for complimentary printables) make copies for your own family or classroom use.
  • You may not resell, sublicense, redistribute, share, or transfer them, whether for free or for a fee; use them to create items for resale or other commercial purposes; use them in logos or branding; or claim copyright or trademark in them.
  • All complimentary downloads and products are provided "as is," without warranty of any kind, express or implied, including the implied warranties of non-infringement, merchantability, or fitness for a particular purpose.

4. Your Responsibilities and Warranties

By uploading User Content, you represent and warrant that you own it or have all rights, consents, and permissions necessary to submit it and to grant the licenses above; that you have the consent of every identifiable person in your photos (or, for a minor, that person's parent or guardian); and that your User Content does not infringe or violate any third party's copyright, trademark, privacy, publicity, or other rights, and complies with our Acceptable Use Policy. You are solely responsible for your User Content.

5. Copyright Infringement Notices (DMCA)

We respect the intellectual-property rights of others and respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. If you believe that content available on or through the Service infringes a copyright you own or control, please send a written notice to our Designated Copyright Agent containing all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
  3. Identification of the material that is claimed to be infringing and that is to be removed, with enough detail (such as URLs or order references) to allow us to locate it;
  4. Your contact information, including name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

[PLACEHOLDER — DESIGNATED AGENT]: Before publishing, confirm the named individual or role serving as Designated Agent and consider registering the agent with the U.S. Copyright Office DMCA Designated Agent Directory (dmca.copyright.gov) to qualify for safe-harbor protection. Add a direct phone number if available.

We may remove or disable access to allegedly infringing material upon receipt of a compliant notice. Notices that are incomplete may not be valid. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.

6. Counter-Notification

If you believe your content was removed or disabled as a result of mistake or misidentification, you may send our Designated Agent a written counter-notification containing:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, mailing address, telephone number, and email address; and
  5. A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, the federal courts in Miami-Dade County, Florida), and that you will accept service of process from the person who provided the original notice or that person's agent.

Upon receipt of a valid counter-notification, we may restore the removed material as permitted by the DMCA unless the original complainant files a court action seeking to restrain the allegedly infringing activity.

7. Repeat Infringers

We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of users who are determined to be repeat infringers of intellectual-property rights.

8. Other Intellectual-Property and Content Removal Requests

This section provides a general procedure for reporting content you believe infringes intellectual-property rights other than copyright (for example, trademark or design rights), or that otherwise should be removed.

Definitions. "Operational Day" means any weekday excluding Saturdays, Sundays, and U.S. federal holidays. "Disputed Material" means any content on the Service alleged to infringe intellectual-property rights. "Intellectual Property Rights" means all patents, rights in inventions, designs, trademarks and trade names and associated goodwill, rights to sue for passing off or unfair competition, copyright and related rights, moral rights, database rights, rights in confidential information and trade secrets, domain names, and all similar rights anywhere in the world, whether registered or unregistered.

How to notify us. While we take reasonable steps to ensure the content we publish does not infringe third-party rights, we cannot entirely rule it out. If you identify content you believe infringes your rights, contact us promptly at hello@mycolorfulworld.art (subject line: "IP Removal Request") and include:

  • Your identity and contact details;
  • Full details of the content you believe infringes, including URLs, screenshots, order references, or other evidence;
  • Particulars of the alleged infringement; and
  • Evidence of your ownership of, or authority to act for the owner of, the relevant Intellectual Property Rights.

We will acknowledge receipt of a request within 7 Operational Days.

9. How We Evaluate and Resolve Claims

Upon receiving a removal request, we will make a preliminary assessment of its credibility and validity. If the request appears credible and valid, we may remove or disable the Disputed Material pending completion of our review or resolution with you. Where the Disputed Material was supplied to us by a third party (for example, a user), we may contact that third party to determine the scope of their rights. We may seek legal advice where appropriate. After our assessment, we will contact you with the outcome and, where relevant, discuss an appropriate resolution. Possible outcomes include (without guarantee): the material remains unchanged where no infringement is found; the material is restored without change; the material is restored under a negotiated license; the material is modified to remove infringing elements; or the material is removed and not republished. If a complaint cannot be resolved and becomes the subject of legal proceedings, the Disputed Material will remain removed and this Policy's procedures will cease to apply to that matter. We reserve the right to modify this Policy as necessary or as required by law.

10. Trademarks

"My Colorful World," the My Colorful World logo, and our other names, logos, and slogans are trademarks of My Colorful World. You may not use them without our prior written permission, and you may not use them in a manner likely to cause confusion or to suggest sponsorship or endorsement by us. All other trademarks appearing on the Service are the property of their respective owners, and their appearance does not indicate any affiliation with or endorsement by My Colorful World.

11. Changes to This Policy

We may update this Policy from time to time. We will update the "Last Updated" date above and, for material changes, provide additional notice where required. Your continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
