My Colorful World ("My Colorful World," "MCW," "we," "us," or "our") respects your privacy and is committed to protecting the personal information of every family that uses our service. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit mycolorfulworld.art, use our web or mobile applications, upload photos to create personalized coloring books or other products, or otherwise interact with us (collectively, the "Service").

Please read this Privacy Policy carefully. By accessing or using the Service, you agree that your access and use are governed by this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Service.

IMPORTANT — FAMILIES AND CHILDREN. Our Service turns your photos into personalized coloring books, and those photos and finished products very often depict children. Accounts may only be created and operated by adults age 18 or older (for example, a parent, grandparent, guardian, or other gift-giver). Because children use the coloring features and appear in the content we process, we treat the Service as directed in part to children and apply the heightened protections of the Children's Online Privacy Protection Act ("COPPA"). See Section 9 — Children's Privacy for how we obtain verifiable parental consent and the choices available to parents and guardians.

1. Who We Are and How to Contact Us

The Service is operated by My Colorful World LLC, located at 16200 NW 59th Ave, Suite 101, Miami Lakes, FL 33014, United States. My Colorful World is the entity ("controller") responsible for your personal information under this Policy.

You can reach us at any time at hello@mycolorfulworld.art, or by mail at the address above marked "Attn: Privacy." Parents and guardians with questions about a child's information should use the same contact details and write "Children's Privacy" in the subject line.

2. Scope of This Policy

This Privacy Policy applies to all personal information we collect through the Service, including our website, our coloring and photo-upload tools, our checkout and gift flows, our customer-support channels, our email and SMS communications, and our social-media pages where we control the data. It does not apply to third-party websites, products, or services that we do not own or control, even where we link to them. See Section 16.

For purposes of this Policy, "personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, and includes "personal data" and similar terms as used in applicable privacy and data protection laws. Personal information does not include information that has been de-identified, aggregated, or anonymized so that it can no longer reasonably be linked to you.

3. Information We Collect

The personal information we collect depends on how you interact with the Service. We may collect the following categories:

  • Identifiers and contact details — your name, email address, telephone number, billing and shipping address, account username, social-media handle, IP address, and online or device identifiers associated with you, your device, or your browsing session.
  • Account information — login credentials, order history, saved preferences, and information you add to your profile.
  • Order and commercial information — products you view, customize, add to cart, or purchase; book size and cover selections; gift-card purchases and redemptions; reviews and ratings you submit; survey responses; and your marketing preferences.
  • Payment information — payment-card number, billing details, and similar payment data, which is processed by our third-party payment processors. We do not store full payment-card numbers on our own systems.
  • Photos and uploaded content — the photographs, images, and any accompanying captions or instructions you upload so that we can create your personalized coloring book or other product. See Section 4.
  • Visual and likeness information — the images of people (including children) and pets that appear in the photos you provide and in the coloring pages we generate from them.
  • Recipient information — when you buy a gift or send a product to someone else, the name, email address, and shipping address of the recipient that you provide.
  • Internet and electronic network activity — how you browse and use the Service, including pages and pages viewed before and after, time spent, clicks, and similar usage data.
  • Geolocation information — approximate location derived from your IP address.
  • Demographic information — such as age range or other details you choose to provide, which in some jurisdictions may be treated as protected-class or sensitive information.
  • Communications — the contents of messages, support requests, and feedback you send us, including chat sessions.
  • Inferences — preferences and characteristics we may draw from the above to personalize your experience.

We collect this information directly from you (when you create an account, place or customize an order, upload photos, contact us, or respond to a survey), automatically through cookies and similar technologies (see Section 8), and from third parties such as our payment processors, fulfillment and print-on-demand partners, analytics and advertising providers, and social-media platforms.

4. Photos, Faces, and Biometric-Adjacent Information

Creating a personalized coloring book requires you to upload photographs, which typically contain images of people's faces (often the faces of children) and pets. We treat these uploads with particular care.

  • What we do with your photos. We use the photos you upload to generate, finalize, and deliver the coloring pages and personalized products you request. For printed products, a combination of our proprietary image-processing technology and a human designer reviews the images before printing; for instant digital pages you generate and download, the line art is produced automatically by AI and delivered to you without individual human review. See Section 6.
  • Facial geometry and biometric laws. Our technology analyzes the visual content of your photos, including facial features, in order to convert them into recognizable line art. To the extent any of this processing is considered to involve "biometric identifiers" or "biometric information" under laws such as the Illinois Biometric Information Privacy Act ("BIPA"), the Texas Capture or Use of Biometric Identifier Act ("CUBI"), or the Washington biometric privacy law, we do not use it to identify any individual, we do not sell it, and we do not disclose it except to the service providers that help us produce your order. By uploading photos, you consent to this processing for the purpose of fulfilling your order, and you confirm you have authority to provide the photos and the consent of (or, for children, parental consent on behalf of) every identifiable person in them.
  • Retention of photos. How long we keep uploaded photos and the coloring pages generated from them depends on how you use the Service: (i) for a printed product order, we keep them as long as needed to produce and deliver the order and support reorders; (ii) for instant digital pages created with a free generation or under a subscription, we keep the uploaded photo and the generated page associated with your session or account so that you can re-download and manage your creations while your account or session is active; and (iii) in all cases we keep them no longer than needed for those purposes, for customer support, and to comply with our legal obligations, after which we delete or de-identify them in accordance with Section 13. You may ask us to delete your uploaded photos and generated pages at any time using the contact details in Section 18, and you may delete your account, which removes the family photos and generated pages associated with it (subject to limited retention required by law).
  • No use for unrelated purposes. We do not use your uploaded family photos to train general-purpose AI models for unrelated products, and we do not use them for advertising, without your separate, explicit consent.

5. How We Use Your Information

We use personal information for the following purposes:

  • To create, customize, produce, and deliver the personalized coloring books and other products you order;
  • To operate, maintain, and improve the Service and its features;
  • To process payments, fulfill and ship orders, and manage gift purchases and redemptions;
  • To create and manage your account and authenticate you;
  • To provide customer service and respond to your requests, questions, and feedback;
  • To communicate with you about your orders, account, and important changes to our policies;
  • To send you marketing communications, special offers, and promotions where permitted, and to tailor content and recommendations to you;
  • To run and administer contests, sweepstakes, surveys, and promotions;
  • To understand how the Service is used, conduct analytics, and develop new products and features;
  • To detect, investigate, and prevent fraud, abuse, security incidents, and activity that violates our policies or the law;
  • To establish, exercise, or defend legal claims and to comply with applicable law and lawful requests;
  • To carry out a merger, acquisition, financing, or other business transaction; and
  • For any other purpose disclosed to you at the time we collect the information or with your consent.

6. How We Use Artificial Intelligence

A core part of our Service uses proprietary, automated image-processing and artificial-intelligence tools to transform the photos you upload into coloring pages. We want to be transparent about this:

  • AI tools convert your photographs into line-art coloring pages.
  • How review works depends on the product. For printed coloring books and other physical products you order, every page is reviewed by a human designer before printing — that output is subject to human oversight before we produce your final product. For instant digital coloring pages that you generate and download on our website or app (including free pages and pages created under a subscription), the line art is generated automatically by AI and delivered to you instantly, without individual human review of each page.
  • You are responsible for reviewing any instant digital page before printing or sharing it, and for ensuring your uploaded photos comply with our Acceptable Use Policy. We may use automated and manual tools to detect and remove prohibited content, but we do not pre-screen every upload.
  • We may also use automated tools to help with customer-support triage, fraud detection, and analyzing aggregated trends and sentiment, in each case subject to human oversight.
  • We do not use automated decision-making that produces legal or similarly significant effects about you without human involvement.
  • As described in Section 4, we do not use your personal family photos to train AI models for unrelated purposes without your explicit consent.

7. How We Disclose Your Information

We do not sell your personal information for money. We may disclose personal information in the following circumstances:

  • Service providers and partners — to companies that perform services on our behalf, such as payment processing, print-on-demand production and fulfillment, shipping and logistics, cloud hosting and storage, image processing, email and SMS delivery, customer-support tooling, analytics, and marketing. These providers are permitted to use the information only to perform services for us.
  • Advertising and analytics providers — to providers that help us measure and deliver advertising and understand use of the Service. As explained in Section 8, some of this activity may be considered a "sale" or "sharing" of personal information or "targeted advertising" under certain U.S. state privacy laws, and we offer you the ability to opt out.
  • At your direction — to recipients of gifts you send, and to any party you ask us to share information with.
  • Corporate transactions — to a buyer, investor, successor, or other party in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale or transfer of assets, and their advisers.
  • Legal and safety — to government authorities, law enforcement, courts, or others when we believe disclosure is necessary to comply with law or legal process; to enforce our terms and policies; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of MCW, our users, or the public, including in an emergency.

We may also create and disclose de-identified or aggregated information that cannot reasonably be used to identify you.

8. Cookies and Tracking Technologies

We and our service providers and partners use cookies, tags, pixels, SDKs, beacons, and similar technologies to operate and improve the Service. We use:

  • Strictly necessary cookies that enable core functionality such as logging in, maintaining your cart, and processing checkout;
  • Performance and analytics cookies that help us understand how visitors use the Service (for example, via Google Analytics);
  • Functional cookies that remember your preferences and personalize features; and
  • Advertising cookies that help us and our partners show you relevant ads on other sites and platforms based on your activity.

Most browsers let you block or delete cookies and clear your cache through their settings. If you reject cookies you may not be able to use all features of the Service, and you will still see non-personalized ads. You can also opt out of interest-based advertising through industry tools such as the Digital Advertising Alliance (youradchoices.com), the Network Advertising Initiative (optout.networkadvertising.org), and, for mobile apps, the AppChoices app, as well as your device's platform controls.

Because some advertising and analytics activity may be considered a "sale" or "sharing" of personal information or "targeted advertising" under U.S. state law, you can opt out using the "Your Privacy Choices" link in our website footer. We honor browser-based Global Privacy Control (GPC) signals as a valid opt-out request for the browser on which they are received.

9. Children's Privacy (COPPA)

We care deeply about children's privacy. Because our Service involves photos and products that depict children and includes features children may use, we apply the protections of COPPA and similar laws.

Accounts are for adults. Only adults age 18 or older may create an account, upload photos, make purchases, or otherwise transact on the Service. We do not permit children to create accounts or submit information to us directly.

Photos that depict children. When an adult uploads photos that depict a child in order to create a personalized product, the adult represents that they are the child's parent or legal guardian, or that they have obtained the consent of the child's parent or legal guardian. By uploading such photos, the parent or guardian provides verifiable parental consent for us to collect and use the child's image and related information solely to create, review, produce, and deliver the ordered product and to provide related customer support, consistent with this Policy.

What we collect about children and why. In connection with a personalized product, the information relating to a child is generally limited to the child's image (as it appears in the uploaded photos and the resulting coloring pages) and any first name or caption the adult chooses to include. We use this information only to fulfill the order and provide support. We do not condition a child's participation on disclosing more information than is reasonably necessary, we do not use children's information for behavioral or targeted advertising, and we do not sell or share children's personal information.

Parental rights. A parent or guardian may, at any time: (a) review the personal information we have collected that relates to their child; (b) refuse to permit further collection or use of that information; and (c) request that we delete it. To exercise these rights, contact us at hello@mycolorfulworld.art with the subject line "Children's Privacy." We may need to verify your identity and your relationship to the child before acting on the request. If you withdraw consent or request deletion, we may be unable to complete or continue an associated order.

No knowing collection from children directly. We do not knowingly collect personal information directly from children under 13. If we learn that we have collected personal information from a child under 13 other than through a consenting parent or guardian as described above, we will delete it promptly. If you believe a child has provided us information without parental consent, please contact us immediately.

10. Your Privacy Rights and Choices

Regardless of where you live, you can:

  • Access and update your account information by logging in or contacting us;
  • Opt out of marketing emails by using the unsubscribe link in any marketing message;
  • Opt out of marketing texts by replying STOP (or CANCEL, UNSUBSCRIBE, or END) to any text message;
  • Manage cookies and interest-based advertising as described in Section 8; and
  • Request deletion of your uploaded photos at any time using the contact details in Section 18.

Opting out of marketing will not stop transactional or service messages about your orders and account.

11. U.S. State Privacy Rights

Depending on your state of residence, you may have some or all of the following rights with respect to your personal information, subject to legal exceptions. These rights are available to residents of states with applicable comprehensive privacy laws, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, among others:

  • Right to know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom we disclose it;
  • Right to delete personal information we have collected from you;
  • Right to correct inaccurate personal information;
  • Right to opt out of the "sale" or "sharing" of personal information and of "targeted advertising";
  • Right to opt out of certain profiling in furtherance of decisions that produce legal or similarly significant effects;
  • Right to limit the use of sensitive personal information; and
  • Right to a list of specific third parties to whom we have disclosed personal information (available to residents of Connecticut, Minnesota, and Oregon).

California-specific disclosures. California residents have the rights above under the California Consumer Privacy Act, as amended ("CCPA"). We do not sell personal information for monetary consideration, and we do not knowingly sell or share the personal information of consumers under 16 years of age. California's "Shine the Light" law (Civil Code § 1798.83) allows California residents to request information about disclosures of personal information to third parties for their direct-marketing purposes; we provide you choice before any such sharing, so we do not disclose your personal information to third parties for their own direct marketing without your consent.

Notice of financial incentive. Some of our discounts, coupons, loyalty offers, or email/SMS sign-up promotions may be considered "financial incentives." Participation is voluntary, you may withdraw at any time, and the value of any incentive we offer is reasonably related to the value of the personal information involved.

How to exercise your rights. Submit a request by emailing hello@mycolorfulworld.art with the subject line "U.S. Privacy Rights," or by using the "Your Privacy Choices" link in our website footer. You do not need an account. We will verify your identity using information we already hold before responding, and you may use an authorized agent with proof of authorization. We honor Global Privacy Control (GPC) signals as opt-out requests. We will not discriminate against you for exercising your rights. If we deny your request, you may appeal by replying to our decision; if you have concerns about our handling of an appeal, you may contact your state attorney general.

12. Notice to Residents Outside the United States (GDPR/UK/Canada)

If you are located in the European Economic Area, the United Kingdom, Canada, or another jurisdiction with comparable data-protection laws, the following additional terms apply. My Colorful World is the controller of your personal information.

Legal bases. We process personal information where: (a) you have given consent; (b) processing is necessary to perform a contract with you (such as fulfilling your order); (c) processing is necessary to comply with a legal obligation; or (d) processing is in our legitimate interests (such as operating and improving the Service, providing support, preventing fraud, and securing our systems), where those interests are not overridden by your rights.

Your rights. Subject to applicable law, you may request to access, rectify, erase, restrict, or object to the processing of your personal information, and to receive a portable copy. You may withdraw consent at any time, and you may lodge a complaint with your local supervisory or data-protection authority. We aim to respond to requests within one month.

13. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to produce and deliver your orders, provide reorders and support, operate and improve the Service, and comply with our legal, tax, accounting, and dispute-resolution obligations.

Uploaded photos and generated coloring pages. For printed product orders, we retain the uploaded photos and the coloring pages generated from them as long as needed to produce and deliver the order and to support reorders and customer service. For instant digital pages (free generations and subscription pages), we retain the uploaded photo and the generated page while your account is active (or, for pages created without an account, for a limited period tied to your browsing session) so you can re-download and manage them; we delete or de-identify them after that period, when you delete them or your account, or when you ask us to, unless a longer period is required by law. Account information and subscription/billing records are retained for the life of your account and for a reasonable period afterward to meet legal, tax, and accounting obligations. When we no longer need personal information, we delete, de-identify, or anonymize it.

14. Information Security

We take commercially reasonable administrative, technical, and physical measures designed to protect personal information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. You use the Service and provide information to us at your own risk, and you are responsible for keeping your account credentials confidential and notifying us promptly of any suspected unauthorized use.

15. International Data Transfers

My Colorful World is based in the United States, and we and our service providers may process, transfer, and store your information on servers located in the United States and other countries where data-protection laws may differ from those in your country. Where required by law, we implement appropriate safeguards for such transfers, such as the European Commission's Standard Contractual Clauses. By using the Service, you understand your information may be processed in the United States.

16. Third-Party Content and Links

The Service may contain links to, or content from, third-party websites, applications, and services that we do not control, including payment processors, social-media platforms, and our fulfillment partners. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third party before providing it with your information.

17. Changes to This Privacy Policy

To the extent permitted by applicable law, we may update this Privacy Policy from time to time. If we make material changes, we will update the "Last Updated" date above and provide notice as required by law, such as by noting the update near the Privacy Policy link or by contacting you directly. Your continued use of the Service after the effective date of the revised Policy constitutes your acceptance of the changes, except where additional consent is required by law (including, for material changes affecting children's information, renewed verifiable parental consent).
