My Colorful World — Terms of Service

IMPORTANT — PLEASE READ CAREFULLY. These Terms of Service (the "Terms") include a mandatory, binding individual arbitration provision and a class-action waiver (see Section 18), which affect how disputes between you and My Colorful World are resolved. By accessing or using the Service, you agree to these Terms.

These Terms are a legal agreement between you and My Colorful World LLC ("My Colorful World," "MCW," "we," "us," or "our") and govern your access to and use of mycolorfulworld.art, our web and mobile applications, our photo-upload and customization tools, our checkout and gift flows, and all related products, content, and services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Acceptable Use Policy, and our Content, IP & DMCA Takedown Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not access or use the Service.

1. Eligibility and Accounts

The Service is intended for adults age 18 or older. By creating an account or placing an order, you represent and warrant that you are at least 18 years old and able to enter into a binding contract. Children may enjoy the coloring products, but only an adult may create an account, upload photos, or make a purchase. Our treatment of children's information is described in our Privacy Policy.

You are responsible for providing accurate, current, and complete information; for keeping your account credentials confidential; and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We may require you to change your password or may restrict your access where we reasonably believe it is necessary.

2. Changes to These Terms

We may modify these Terms (and any policy incorporated into them) at any time. If we make changes, we will update the "Last Updated" date above and post the revised Terms on the Service; for material changes we will provide additional notice where required by law. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of them. If you do not agree to the revised Terms, you must stop using the Service.

3. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. Prices, products, and promotions described on the Service may change at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service or any part of it.

4. Our Content and License to You

All content we make available through the Service — including text, graphics, logos, designs, software, the look and feel of the Service, sample artwork, and the coloring-page outputs and templates we create (other than your User Content) ("MCW Content") — is owned by My Colorful World or its licensors and is protected by intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service, and to use the personalized product you purchase, for your personal, non-commercial, family use only. You may not copy, modify, distribute, sell, lease, reverse engineer, create derivative works from, publicly display, or otherwise exploit any MCW Content or any part of the Service except as expressly permitted by these Terms or with our prior written consent. All rights not expressly granted are reserved.

The finished personalized coloring book you purchase is yours to use, color, and enjoy within your family; this does not grant you any right to resell, mass-reproduce, or commercially exploit the MCW-created artwork or templates.

5. User Content and the License You Grant Us

"User Content" means any photographs, images, captions, instructions, reviews, comments, feedback, or other materials you upload, submit, or transmit through the Service. You are solely responsible for your User Content. We have no obligation to pre-screen, monitor, or store User Content, but we reserve the right to do so and to remove or refuse any User Content at our discretion.

We operate a two-tier license for User Content:

(a) Photos and content you provide to create a product. For User Content you submit so that we can create, produce, and deliver a personalized product you order (such as the photos that become your coloring pages), you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, modify, create derivative works from (e.g., convert into line art), and process that User Content — together with the names, likenesses, and other personal attributes of the people and pets identifiable in it — solely for the purpose of making and delivering the products and services you order, providing reorders and customer support, and complying with our legal obligations. We will not use these personal family photos for advertising or to train AI for unrelated purposes without your separate, explicit consent.

(b) Reviews, comments, and other public submissions. For User Content that is not provided to fulfill an order — such as reviews, ratings, testimonials, photos you choose to post publicly, or social-media tags — you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, distribute, modify, adapt, publish, translate, publicly perform, and publicly display that User Content, in whole or in part, in any media now known or later developed, for operating, promoting, and improving the Service. You waive any moral rights in such User Content to the extent permitted by law.

We may create and use de-identified, aggregated, or anonymized data derived from User Content for any lawful purpose. We do not claim ownership of your User Content; as between you and us, you retain the rights you hold in it, subject to the licenses above.

6. Your Representations About Photos and People in Them

Because our Service depends on photos that often depict other people, including children, you represent and warrant that, for all User Content you submit:

  • You own it or have all rights, licenses, consents, and permissions necessary to submit it and to grant the licenses in Section 5;
  • You have the consent of every identifiable individual in the photos (or, where an individual is a minor, the consent of that minor's parent or legal guardian) to upload the photos and to have them processed into a personalized product;
  • If you are uploading photos of a child, you are the child's parent or legal guardian, or you have obtained the verifiable consent of the child's parent or legal guardian;
  • Where you are sending a product to another person, you have that recipient's consent to provide their information, and you — not MCW — are the sender; we act only as a delivery agent;
  • Your User Content is accurate and does not infringe or violate any third party's intellectual-property, privacy, publicity, or other rights; and
  • Your User Content complies with these Terms and our Acceptable Use Policy and applicable law.

You are responsible for keeping your own copies of any photos you upload. We are not a backup or storage service.

7. Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy, which prohibits, among other things, unlawful, infringing, harmful, or abusive conduct and content. We may investigate suspected violations and may remove content, suspend production or shipping of an order, or suspend or terminate your access, in each case as described in those policies and Section 14.

8. Orders, Pricing, and Payment

8.1 One-time orders

All orders are subject to acceptance by us. We may refuse, limit, or cancel any order, including where we suspect fraud, an error in pricing or product information, or a violation of these Terms. Prices are shown in U.S. dollars unless stated otherwise and are exclusive of taxes and shipping unless stated. You authorize us and our payment processors to charge your selected payment method for the total amount of your order, including taxes and shipping. You represent that you are authorized to use the payment method you provide.

If a product or pricing error is discovered after you place an order, we may cancel the affected order and refund any amount charged.

8.2 Free generations

We may offer a limited number of free coloring-page generations or downloads (for example, a set number of free pages per visitor or account). Free generations are provided "as is," may be watermarked or require you to provide an email address to download, and are subject to limits we set and may change at any time. Free generations have no cash value, are for personal, non-commercial use, and may be discontinued at any time.

8.3 Subscriptions and automatic renewal

We offer paid monthly subscription plans (for example, "Color" and "Color+") that give you a set number of coloring-page generations each billing period. Please read this section carefully — our subscriptions automatically renew.

  • What you get and what it costs. Each plan's price and the number of pages included per month are shown at the point of purchase (currently Color — $7.99/month for 50 pages and Color+ — $12.99/month for 100 pages). Included pages are for personal, non-commercial use, reset each billing period, and do not roll over to the next period. Plan names, prices, and included amounts may change as described below.
  • Authorization and automatic renewal. When you start a subscription, you authorize us and our payment processor (Stripe) to charge your payment method the then-current plan fee (plus any applicable taxes) immediately and then automatically at the start of each successive monthly billing period, on a recurring basis, until you cancel. Your subscription will continue and automatically renew each month unless and until you cancel it.
  • How to cancel. You may cancel at any time through the "Manage billing" area of your account (which opens our payment processor's secure customer portal) or by emailing hello@mycolorfulworld.art. Cancellation takes effect at the end of the current billing period: you keep access to your plan and any remaining pages until that date, and you will not be charged again after you cancel. Canceling is easy and takes about the same number of steps as signing up.
  • Refunds. Except where required by law, subscription fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused pages, or periods during which you did not use the Service. If you believe you were charged in error, contact us at hello@mycolorfulworld.art and we will review it in good faith.
  • Price and plan changes. We may change subscription prices or the pages included in a plan. If we make a change that applies to your subscription, we will give you advance notice (for example, by email to the address on your account) before it takes effect, and the change will apply to your next billing period. If you do not agree, you may cancel before the change takes effect; your continued subscription after the effective date constitutes acceptance of the new price or terms.
  • Failed payments. If a renewal payment fails (for example, an expired or declined card), we may retry the charge and will attempt to notify you so you can update your payment method in the customer portal. If we cannot successfully charge you, we may suspend or cancel your subscription and your access to paid features.
  • Free trials and promotions. If we offer a free trial or promotional rate, the terms (length, what happens when it ends, and how to cancel before being charged) will be disclosed at sign-up. Unless you cancel before the trial or promotional period ends, your subscription will automatically convert to a paid subscription and renew at the then-current price.

By starting a subscription you acknowledge that you have read and agree to this Section 8.3, including that your subscription renews automatically and your payment method will be charged on a recurring basis until you cancel.

9. Production, Shipping, and Delivery

Our products are made to order. Because each book is custom-produced, reviewed by a human designer, printed, and shipped, please allow the production and delivery time stated at checkout (typically several business days for production plus shipping transit). Delivery time estimates are not guarantees. Title and risk of loss pass to you upon our delivery of the product to the carrier. We are not responsible for delays caused by carriers, incorrect addresses you provide, or events beyond our reasonable control.

10. Returns, Refunds, and Cancellations

Personalized printed products. Because our printed products are personalized and made to order, they generally cannot be returned or resold. However, if your product arrives defective, misprinted, or damaged in transit, we will make it right — contact us at hello@mycolorfulworld.art within 30 days of delivery with your order number and a photo of the issue, and we will provide a reprint or a refund at our discretion. We may ask you to confirm details before issuing a remedy. Orders may be changed or canceled only before production begins; once a personalized item enters production, it generally cannot be changed or canceled. (MCW may update the specific reporting window and remedy details; the version posted at the time of your order applies.)

Subscriptions. Subscription cancellations and refunds are governed by Section 8.3. In short: you may cancel at any time and keep access through the end of your current billing period, and subscription fees are non-refundable except where required by law.

Free generations have no cash value and are not refundable.

11. Gift Cards and Gifting

You may purchase a gift or gift card that allows a recipient to upload their own photos and receive a personalized product. Gift cards have no cash value except as required by law, cannot be redeemed for cash, and may not be resold. When you send a gift, you are responsible for providing accurate recipient information and for having the recipient's consent to share it, as described in Section 6. The recipient's use of the Service is also governed by these Terms.

12. Intellectual Property and Takedown Claims

We respect intellectual-property rights and expect you to do the same. If you believe content on the Service infringes your copyright or other intellectual-property rights, please follow the procedures in our Content, IP & DMCA Takedown Policy. We may, in appropriate circumstances and at our discretion, remove allegedly infringing content and terminate the accounts of repeat infringers.

13. Third-Party Links and Services

The Service may contain links to, or integrate with, third-party websites, applications, and services (such as payment processors, social-media platforms, and fulfillment partners) that we do not control. We are not responsible for the content, products, services, or practices of any third party, and your dealings with third parties are solely between you and the third party. Your use of third-party services is subject to their terms and policies.

14. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, remove or refuse content, and cancel or refuse to ship orders, with or without notice, if we reasonably believe you have violated these Terms or any incorporated policy, engaged in fraudulent or unlawful conduct, or created risk or possible legal exposure for us. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including Sections 4, 5, 6, and 15–21 — will survive.

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. MY COLORFUL WORLD AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS (THE "MCW PARTIES") EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE OR ITS SERVERS ARE FREE OF HARMFUL COMPONENTS, OR THAT ANY RESULTS OBTAINED FROM THE SERVICE WILL MEET YOUR EXPECTATIONS. NO ADVICE OR INFORMATION OBTAINED FROM US CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In those cases, such warranties are limited to the minimum scope and duration permitted by law.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE MCW PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF AN MCW PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE MCW PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO MY COLORFUL WORLD IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND US.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or fraudulent misrepresentation.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the MCW Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content, including any claim that it infringes or violates the rights of a third party (such as a person depicted in a photo, or a copyright or publicity-rights holder); (b) your use of or inability to use the Service; (c) your violation of these Terms or any incorporated policy; (d) your violation of any rights of another party; or (e) your violation of any applicable law. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense. This section survives termination.

18. Binding Arbitration and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND MY COLORFUL WORLD TO RESOLVE DISPUTES THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION AND CONTAINS A WAIVER OF CLASS ACTIONS AND JURY TRIALS.

(a) Agreement to arbitrate. You and My Colorful World agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by final and binding individual arbitration, rather than in court, except that (i) either party may bring an individual claim in small-claims court if it qualifies, and (ii) either party may seek injunctive or other equitable relief in court for actual or threatened infringement or misuse of intellectual property. The Federal Arbitration Act governs the interpretation and enforcement of this section.

(b) Informal resolution first. Before initiating arbitration, you agree to first contact us at hello@mycolorfulworld.art with a written description of the Dispute and to attempt in good faith to resolve it informally for at least 60 days. This is a condition precedent to starting arbitration.

(c) Arbitration rules and forum. The arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer rules, before a single arbitrator. The arbitration may proceed by document submission, telephone, or video, or in person in the county where you reside, at your election.

(d) Class-action and jury-trial waiver. YOU AND MY COLORFUL WORLD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY ON AN INDIVIDUAL BASIS. YOU AND MY COLORFUL WORLD WAIVE ANY RIGHT TO A JURY TRIAL. If the class-action waiver in this paragraph is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and may proceed in court.

(e) 30-day right to opt out. You may opt out of this arbitration agreement by sending written notice to hello@mycolorfulworld.art within 30 days of first accepting these Terms, stating your name and your intent to opt out of arbitration. If you opt out, neither you nor MCW will be required to arbitrate Disputes; instead, Disputes will be resolved in the courts identified in Section 19.

(f) Severability and survival. If any portion of this Section 18 (other than the class-action waiver, which is governed by paragraph (d)) is found unenforceable, the remainder will remain in effect. This Section 18 survives termination of your relationship with us.

19. Governing Law and Venue

These Terms and any Dispute are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and, where applicable, by the Federal Arbitration Act. The United Nations Convention on Contracts for the International Sale of Goods does not apply. For any Dispute not subject to arbitration, you and My Colorful World consent to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida, and waive any objection to those courts on grounds of inconvenient forum.

20. Mobile and App Store Terms

If you access the Service through a mobile application, you are responsible for any carrier data and messaging charges, and you must provide the equipment and software needed to use the application. If you download our application from a third-party app store (such as the Apple App Store or Google Play), these Terms are between you and My Colorful World, not the app store. The app store is not responsible for the application or its content, and is a third-party beneficiary of these Terms with the right to enforce them. You represent that you are not located in an embargoed country or on any government list of prohibited or restricted parties, and you agree to comply with all applicable export-control laws.

21. General Provisions

  • Electronic communications. By using the Service, you consent to receive communications from us electronically, and you agree that electronic notices satisfy any legal requirement that communications be in writing.
  • Entire agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy, Content/IP & Takedown Policy, and any supplemental terms (such as promotion or purchase terms) presented to you, constitute the entire agreement between you and My Colorful World regarding the Service and supersede any prior agreements. If there is a conflict, the supplemental terms control for the specific feature they govern.
  • Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely.
  • Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
  • Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, epidemics or pandemics, war, terrorism, civil unrest, labor disputes, supply shortages, carrier delays, utility or internet failures, fire, or flood.
  • Headings. Section titles are for convenience only and have no legal effect.
